Terms and Conditions of Use – Escudo Vial

Escudo Vial is a cutting-edge legal assistance platform powered by Artificial Intelligence. Although Escudo Vial is not a law firm, the system has been designed by AI experts who have developed a specialized central legal brain. This core has been subjected to rigorous stress tests and real case simulations for hundreds of hours, achieving perfection in its capacity for legal analysis and argumentation. Our technology remains constantly synchronized with the Official Gazette El Peruano, allowing the app's architecture to adapt in real time to any modification in the National Traffic Regulations (016-2009-MTC) or the General Administrative Procedure Law, and strictly bases its defenses on the Constitution and the binding precedents of the Constitutional Court (TC) to shield citizens from authority abuse. The application facilitates the drafting of technical defenses; however, the final decision on fines rests exclusively with the competent administrative authority.

The user agrees that the cost of services is determined by case complexity and infrastructure (API) costs:

• Base Service (S/49): Fines for photo-tickets or violations not involving accidents or damages to third parties.

• Complex Cases (S/149): Incidents with property damage or DUI cases provided a third party caused the accident.

• Critical Cases (S/299): Situations involving fatalities, exclusively when the user claims and can prove that a third party caused the accident. This cost reflects the exhaustive AI analysis for a high-liability scenario.

• Fleet Annual Pass (S/499): Subscription plan providing unlimited appeals for up to 10 vehicles over a 365-day period.

• Out of Scope: In cases where the user is the direct cause of an accident with fatal consequences, Escudo Vial will not generate automatic defenses. The system will block the process and recommend the immediate hiring of a private criminal defense attorney, as these cases exceed the scope of an AI assistant.

• Notice of Change: Escudo Vial reserves the right to modify its prices based on API demand. Any change in the base rate will be notified with a minimum of 30 calendar days in advance.

Given the discretionary nature of authorities and the variability of evidence, Escudo Vial does not guarantee success in all cases. The service is considered rendered upon generating the technical defense document. The payment corresponds to the processing of information and not the outcome of the administrative procedure.

• Basic Cases: According to Art. 124 of Law No. 27444, the administered party may exercise their defense by themselves. Documents generated for basic cases do not require a lawyer's signature.

• Cases with Fatalities: Due to criminal implications, it is mandatory that the generated document be reviewed, edited, and signed by a licensed criminal lawyer before its official submission.

Escudo Vial uses principles of Law 27444 to argue the nullity of fines notified outside statutory deadlines or through irregular procedures, provided the user supplies the necessary evidence of such lack of notification.
